Discord Lawsuit Update (2026)

March 18, 2026 - Florida Attorney General Issues Subpoenas and Announces Civil Investigation of Discord

Florida Attorney General James Uthmeier announced his office has launched a civil investigation and labeled Discord as a "safe haven for child predators." Uthmeier's office sent numerous subpoenas with the goal of learning what Discord knows about specific sexual exploitation, grooming, and abuse incidents. 

More specifically, the subpoenas seek information concerning Discord's marketing materials geared towards either children or their legal guardians, wherein the platform marketed itself as safe. They are also seeking materials related to content and platform moderation

"It’s clear that predators see a safe haven on the Discord app,” Uthmeier said. “They believe that they’re protected, and that it might be harder for them to be monitored — for them to be tracked — by either parents or law enforcement."

Keep in mind that the Florida Attorney General previously sued Roblox months ago, and we believe a lawsuit against Discord is forthcoming. There is substantial documentation of the proliferation and dissemination of child sexual abuse material on Discord. We expect other state Attorney Generals to begin investigations into the systemic sexual exploitation of children on the Discord platform soon.

April 17, 2025 - New Jersey Attorney General Files Discord Lawsuit - First Attorney General to sue Discord

New Jersey became the first state in the nation to take legal action against Discord today. The lawsuit alleges Discord knowingly exposes children to online sexual predators, violent or harmful content, and sexual exploitation.

Further, the complaint alleges that Discord placed growth over profit with extremely lax safety standards. Discord knowingly ignored documented instances of sexual exploitation, grooming and the dissemination of CSAM.

Finally, the lawsuit takes issue with Discord's failure to warn parents of known dangers on the platform.

January 27, 2025 - Florida Man caught Luring Three Young Boys via Discord

A Florida man (Jacob Lozano) was sentenced to thirty-two (32) years in prison for targeting and exploiting three young boys via the Discord platform. Lozano contacted each of the three children through Discord and convinced them to create videos of themselves and send them to him.

A vigilant mother found explicit images on her 11-year-old son's phone and contacted the National Center for Missing and Exploited Children. Law enforcement began investigating Lozano, where they found the perpetrator had sent private direct messages to two other boys. 

August 12, 2024 - Virginia Governor Sends Letter to Discord warning of Violent Groups Targeting Children

A news article out of Virginia, highlights a growing threat of violent groups who have been targeting children on Discord. According to multiple parents interviewed in the aforementioned article, groups operating on Discord have targeted children to commit self-harm. Multiple documented suicide attempts have been reported on.

June 21, 2023 - NBC News Publishes Report on Child Sexual Predators Utilizing Discord

NBC News is the first media source to blow the proverbial whistle on the sexual exploitation of children on Discord. In a shocking report, NBC News illustrated how sexual predators utilize hidden communities and chat rooms to both groom children and trade child sexual abuse materials (CSAM - pictures of children in sexual acts). 

Additionally, NBC News uncovered 165 incidents wherein adults were prosecuted for disseminating or receiving CSAM on Discord. This includes multiple crime rings that have operated with impunity on Discord. These crime rings trade in child pornography/CSAM. The report focuses on how Discord misled parents as to the safety of their platform while possessing direct knowledge that predators utilize the site to target children. 

In many of the 165 documented incidents, adults extorted (known as sextortion) children with explicit material they threatened to reveal unless paid a bounty.

How Discord Will Defend These Lawsuits

Mandatory Arbitration

Discord (similar to Roblox) is attempting to force minor sexual abuse survivors into binding arbitration, which is stated within their terms of service. It is worth noting, in the social media harm litigation; Meta and Snap (Snapchat) both opted not to enforce the same mandatory arbitration provision that was in their terms of service. Further, in the Roblox lawsuit, Meta and Snap have been named as co-defendants in many cases and have again opted not to enforce binding arbitration.

At the time of writing this article, both Roblox and Discord are attempting to force minor sexual abuse survivors into arbitration. We strongly believe this argument or strategy will inevitably fail for Discord.

Notwithstanding the mass of arguments plaintiffs have at their disposal against any attempt to compel a minor to participate in arbitration, we now have the Ending Forced Arbitration Act (EFAA), enacted into law in March of 2022. The EFAA prevents victims of sexual abuse from being forced into mandatory arbitration.

Section 230 of the Communications Decency Act

Section 230 serves to immunize internet platforms from content posted by a third party. However, a recent decision by the Ninth Circuit Court of Appeals creates a roadmap for pleading around Section 230 by arguing this is nothing more than a design defect case. It is our belief that Discord was negligently designed and was never safe in its original construct.
